Exemptions for composting certification extended

1. Extension to existing class exemption

Extra time has been provided for items which met the previous class exemption SUP0001/2022/2 to achieve their Australian composting certification.

The supply of a prescribed plastic item is only exempt under this notice where that prescribed plastic item:

  • has a current and valid EN13432 composting or TUV OK compost HOME certification; and/or
  • has a current application before the Australasian Bioplastics Association (ABA) for its certification under the Australian composting standards AS4736:2006 or AS5810:2010 awaiting a determination.

Note: The Environmental Protection (Prohibited Plastics and Balloons) Regulations 2018 do not recognise European certification. Australian certification must have been achieved to supply items when this class exemption expires.

Prescribed plastic items and expiry

  • A bowl made from plastic lined paperboard – Expiry 31 December 2023
  • A cup for cold beverages, made from plastic lined paperboard – Expiry 31 December 2023
  • A food container made from plastic lined paperboard – Expiry 31 December 2023

2. Class exemption applies to some items in new bans

The supply of a prescribed plastic item is only exempt under this notice where that prescribed plastic item:

  • has a current and valid EN13432 composting or TUV OK compost HOME certification; and/or
  • has a current application before the Australasian Bioplastics Association (ABA) for its certification under the Australian composting standards AS4736:2006 or AS5810:2010 awaiting a determination.

Prescribed plastic items and expiry

  • A cup for hot beverages, made from plastic – Expiry 1 March 2025
  • A food tray made from plastic lined paperboard – Expiry 1 March 2025
  • A lid for a food container, bowl, tray, or plate made from plastic lined paperboard – Expiry 1 September 2025
