Food containers at mine sites – extension
Class Exemption Notice

On 16 July 2024, the WA Government published a class exemption allowing extra time for the sale
and supply of plastic takeaway food containers and lids to mine sites with onsite kitchens.
This exemption is limited to mine sites where food is made and packaged onsite to be collected by staff. This includes all food that requires reheating in a microwave to comply with the Food Act 2008 and associated standards and regulations.
These specific containers and their lids provided at mine sites will be provided an extension until 30 August 2025 to comply (those who wish to use this exemption must supply information to the Department by a certain date).
Currently there are limited food packaging options available for remote mine sites with onsite kitchens that provide an effective barrier for prolonged storage and are microwave safe.
How are mine sites defined?
As per the class exemption notice, “means mine sites, exploration camps and construction villages.”
What about other banned items?
The class exemption ONLY applies to food containers and their lids supplied in the manner above. The exemption does NOT apply to any other items listed under the regulations.
How to use this exemption
Mine sites must notify the WA Government of their intent to use. Suppliers and manufacturers who supply mine sites with onsite kitchens should check that the businesses have notified the WA Government they intend to use the class exemption. There is no requirement for suppliers and manufacturers to notify.
What do I need to do?
Before 30 August 2024, or within 30 days of adding a product under this exemption, someone using this exemption, must provide specific information to the Department via this online form.

Can the exemption change in future?
In accordance with regulation 20(5) of the regulations this exemption notice may be revoked or varied by the CEO or a Delegated Officer at any time by written notice.
