Extra time for some expanded plastic packaging

Class Exemption Notice

On Tuesday, 28 May 2024, the WA Government published a class exemption allowing extra time for electronic products weighing between 25 kg and 45 kg, net weight, that require moulded expanded plastic packaging.

This exemption is designed to support the industry in transitioning away from such packaging for heavier electronic products.


Who does this apply to, and how?

This class exemption notice will be active until 30 June 2026. It applies to manufacturers, suppliers, and purchasers of electronic products weighing between 25 kg and 45 kg, net weight, that require moulded expanded plastic packaging. The exemption covers the manufacturing date (initially before 1 July 2024) and the product sale date (initially banned from 1 July 2025) for these electronic products.

If you are a manufacturer or supplier considering operating under this class exemption notice, we
strongly advise that you familiarise yourself with the conditions outlined in SUP0002/2024/1.

There is no requirement to apply for this exemption. However, it is recommended that manufacturers and suppliers notify the WA Department of Water and Environmental Regulation of their intent to use this exemption via email: plastic-exemptions@dwer.wa.gov.au

All requirements for products other than electronic products and for all electronic products under 25 kg remain unchanged.


How to use this exemption

Manufacturers, suppliers and retailers do not need to submit the same information if another supply chain member has already submitted it. Please communicate with your supply chain to determine whether information has been provided.

The National Retail Association recommends that manufacturers or businesses who own the branding of items using the class exemption notify the WA Government of their intent to use via this online form. We also recommend that the manufacturers or businesses who own the branding of items provide information with each item they are currently using this class exemption to assist businesses selling these items to the end users.
